In the evolving landscape of healthcare coverage, ensuring parity between mental health/substance use disorder (MH/SUD) and medical/surgical (Med/Surg) services is crucial. The Mental Health Parity and Addiction Equity Act (MHPAEA) of 2008, along with subsequent updates at both state and federal levels, mandates this parity to prevent discrimination and inequities in treatment. The latest update, published in the Federal Register on September 23, 2024, has introduced additional compliance expectations for both ERISA and non-ERISA plans.
A key component of MHPAEA compliance is the comparative analysis of Non-Quantitative Treatment Limitations (NQTLs). Issuers are required to provide documentation supporting their compliance with parity requirements, specifically through an NQTL comparative analysis upon request. While the law does not specify an exact timeframe to provide, this analysis is typically expected to be provided within 10 days of request to governing bodies like Department of Labor (DOD), and typically 30 days when requested by plan participants, and providers. However, many employer groups and health plans find it challenging to interpret these rules and validate their analyses. If an issuer has not already conducted a comparative analysis, meeting the typical 10-day turnaround can also be challenging since these can take a lot of time given complexity.
